These Terms of Service govern your use of lume-portraits.com and purchases from Lume Portraits, operated by Clavis International Trading Limited. By using the website or placing an order, you agree to these Terms and the policies linked on our store.

Eligibility and account information

You must have legal capacity to enter a contract and provide accurate, current information. You are responsible for activity under your account and for safeguarding account credentials.

Products and orders

Product descriptions, availability, pricing, and offers may change. We may correct errors and may reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, unavailable materials, unlawful content, or an inability to fulfill the order. If we cancel an order after payment, we will provide the required refund.

Customer images and instructions

You retain your rights in photographs you upload. You grant us and our service providers a limited permission to use, reproduce, adapt, and transmit the photograph only as needed to create proofs, complete revisions, manufacture and deliver the product, provide support, prevent fraud, and comply with law. We will not use it for advertising or promotion without separate permission.

You confirm that you own the uploaded content or have all permissions needed for us to use it for the order. You must not submit unlawful, infringing, abusive, or privacy-violating content. We may refuse content that we reasonably believe violates these requirements.

Artwork proofs and approval

We provide an artwork proof before production. You may approve the proof or request reasonable revisions, with no fixed limit on revision rounds. Cancellation is available only before the first proof is delivered. Once you approve a proof, production begins immediately and the approved design cannot be changed or cancelled.

You are responsible for reviewing the proof carefully. The finished product may have minor differences in color or appearance due to screen settings, photograph quality, materials, scale, and manufacturing processes. Material differences from the approved proof remain subject to our Refund Policy and applicable law.

Prices and payment

Prices are shown in the currency displayed at checkout. Applicable taxes may be calculated at checkout. Payment must be authorized before we process the order. We use third-party payment providers and do not directly store full payment-card details.

Shipping

We currently ship only to the United States. Free tracked shipping, production and delivery estimates, duties, delays, and delivery issues are governed by our Shipping Policy.

Returns, replacements, and refunds

Custom orders are non-returnable and non-refundable after the first proof is delivered, subject to remedies for damaged, defective, incorrect, lost, delayed, or unfulfilled orders and any rights that cannot legally be excluded. Please review our Refund Policy.

Intellectual property

The website, branding, text, graphics, store design, and other materials supplied by us are owned by or licensed to Clavis International Trading Limited and are protected by applicable intellectual-property laws. You may use the website only for personal shopping purposes and may not copy, distribute, reverse engineer, scrape, or commercially exploit it without permission.

Acceptable use

You must not misuse the website, introduce malicious code, interfere with security or operation, attempt unauthorized access, violate law, infringe another person’s rights, or use the services for fraudulent or abusive activity.

Third-party services and links

Our services rely on Shopify and other third parties. Third-party websites and services are governed by their own terms and privacy notices. We are not responsible for third-party content or services beyond the extent required by law.

Disclaimers and liability

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. We do not exclude warranties, remedies, or liabilities that cannot legally be excluded. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from use of the website or services. Any limitation applies only to the extent permitted by applicable law.

Indemnity

To the extent permitted by law, you agree to indemnify Clavis International Trading Limited against third-party claims arising from content you submit, your unlawful use of the services, or your violation of these Terms or another person’s rights.

Governing law

These Terms are governed by the laws of Hong Kong SAR, and disputes are subject to the courts of Hong Kong SAR. This clause does not remove mandatory consumer rights or protections that apply to you in the United States or another applicable jurisdiction.

Changes and severability

We may update these Terms by posting a revised version. Changes apply prospectively from the stated update date. If a provision is found unenforceable, the remaining provisions continue in effect.
